The federal government passed the Smith Act of 1940 which made it a criminal offense to promote in any way the act of overthrowing the United States government.
This eventually included supporting Communism. As a result, the House Committee on Un-American Activities Committee had legislative grounds to prosecute people whose purpose seemed to be to promote Communism in the United States.
